Lawsuit File in Incinerator Fire

News 13 is being subpoenaed for video of the February 2012 Bay County incinerator fire.

The insurance companies:

  • Westchester Surplus Lines Insurance Company
  • Axis Surplus Insurance Company
  • Certain Underwriters at Lloyds
  • Alterra Excess and Surplus Insurance Company
  • Aspen Speciality Insurance Company
  • Essex Insurance Company and
  • Endurance American Speciality Insurance Company

are suing the businesses who installed the fire suppression system after the fire in 2008. The parties named as Defendants in the suit are:

  • Southeast Fire Protection, LLC
  • Fire & Life Safety American, Inc. and
  • James M. Curtis, P. E.

The recent fire shut down the incinerator for nearly a year. The blaze caused more than $30m in damages. Bay County had to pay a $25,000 deductible for repairs.

Bay County owns the facility and hires Engen to operate it. The suit says Engen contracted with Southeast Fire Protection.

The County's insurance providers allege that Southeast Fire Protection;

  • Selected and installed an undersized fire suppression system
  • Failed to account for the fact that the fire pump would need to supply water to the sprinklers and cannons simultaneously and
  • Designed, located and installed a system that did not provide adequate coverage of the piles.

The insurance groups are seeking unspecified damages in excess of $15,000. The next court date is set for June 6, 2013.
